1. INTRODUCTION / INTRODUCTION


Welcome to QuickGrab. These Terms and Conditions ("Terms") govern your use of the QuickGrab platform, including our website and mobile application (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.


2. ELIGIBILITY AND ACCOUNT REGISTRATION

2.1 Age Requirements

Different services on our Platform have different age requirements:

  • DSTV Subscription services: 12 years or older
  • Prepaid card services: 15 years or older
  • Settlements and Quick Help services: 18 years or older

2.2 Account Creation

To use our services, you must create an account by providing:

  • Full legal name
  • Valid email address (which will be verified)
  • Phone number (must be a WhatsApp-enabled number)
  • Secure password

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Know Your Customer (KYC) Verification

For certain services, particularly Quick Help and higher-value transactions, we require KYC verification. This process involves:

  • Providing government-issued identification (front and back)
  • Legal name as it appears on your ID
  • Current address
  • Recent passport photograph
  • Valid email address

You understand that you cannot access certain services without completing this verification process.

3. SERVICES

3.1 Settlements

Our Platform allows you to settle various payments. Each settlement transaction may be subject to service fees clearly displayed before you confirm the transaction.

3.2 DSTV Subscription

We facilitate DSTV subscription payments. While we verify smart card numbers free of charge, the subscription payment services may include processing fees.

3.3 Prepaid Card Services

We provide prepaid card services subject to the specific terms associated with each card provider. Details of any associated fees will be clearly displayed before transaction confirmation.

3.4 Quick Help

QuickGrab offers financial assistance services ("Quick Help") subject to the following conditions:

  • Completion of KYC verification
  • Provision of collateral of equivalent or greater value than the assistance requested
  • Compliance with repayment terms provided at the time of approval
  • Additional terms specified in the Quick Help agreement presented at the time of application

3.5 Account Balance

Users maintain an account balance within the Platform that can be:

  • Topped up using approved payment methods
  • Used to pay for services on the Platform
  • Withdrawn subject to applicable withdrawal fees

4. USER RESPONSIBILITIES

4.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Restricting access to your device
  • All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4.2 Prohibited Activities

You agree not to engage in any of the following activities:

  • Providing false or misleading information
  • Using the Platform for illegal purposes
  • Attempting to defraud QuickGrab or other users
  • Circumventing or manipulating our fee structure
  • Interfering with the proper operation of the Platform
  • Accessing or attempting to access other users' accounts
  • Using the Platform in any manner that could damage or overburden it
  • Reverse engineering any aspect of the Platform or doing anything that might discover source code
  • Using the Platform to send unsolicited communications

5. PAYMENTS AND FEES

5.1 Payment Methods

We accept various payment methods which may differ based on your location. Available payment methods will be displayed during the checkout process.

5.2 Fees

We charge fees for certain services including:

  • Transaction processing fees
  • Withdrawal fees (as specified on our blog)

All applicable fees will be clearly displayed before you confirm any transaction.

5.3 Currency

All transactions are processed in the local currency of your country or in XAF (Central African CFA franc).

6. TERMINATION AND ACCOUNT SUSPENSION

6.1 Account Suspension

Your account may be suspended if:

  • We detect suspicious or potentially fraudulent activity
  • You violate these Terms
  • We are required to do so by law or regulation
  • We believe suspension is necessary to protect our Platform, our users, or the public

If your account is suspended, you must contact our technical support team to resolve the issue. During suspension, you will not be able to access any services on the Platform.

6.2 Account Deletion

You may delete your account by:

  1. Logging into your account
  2. Navigating to Account > Settings
  3. Scrolling to the "Danger Zone" section
  4. Clicking on the "Delete Account" button
  5. Typing "DELETE ACCOUNT" when prompted
  6. Following the link sent to your registered email (valid for 5 minutes)
  7. Confirming your password on the deletion page

Upon account deletion, all your data, including your account balance, will be permanently erased.

7. PRIVACY AND DATA PROTECTION

7.1 Data Collection and Usage

We collect and process your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy explains how we collect, use, and protect your personal information.

7.2 KYC Information

Your KYC verification information is stored securely on our backup servers. Physical copies are also maintained in accordance with applicable regulations. This information is used solely for verification purposes and to comply with applicable laws and regulations.

7.3 Marketing Communications

By creating an account, you consent to receive marketing communications from us. You can opt out of these communications at any time through your account settings or by following the unsubscribe instructions in our emails.

8. SERVICE INTERRUPTIONS AND SUPPORT

8.1 Service Availability

While we strive to ensure the Platform is available at all times, we do not guarantee uninterrupted access. The Platform may be unavailable during maintenance periods or due to technical issues beyond our control.

8.2 Technical Support

If you experience issues with our services or payment processing, please contact our support team at [Support Email] or through the support function on our Platform.

9. INTELLECTUAL PROPERTY

9.1 Our Intellectual Property

The Platform, including all content, features, and functionality, is owned by QuickGrab and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our express written consent.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for its intended purposes, subject to these Terms.

10. LIMITATION OF LIABILITY

10.1 Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKGRAB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
  • ANY CONTENT OBTAINED FROM THE PLATFORM
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

10.3 Monetary Cap on Liability

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless QuickGrab, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cameroon, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through:

  1. Informal negotiation - We encourage you to contact us first to seek a resolution
  2. Formal mediation in Cameroon
  3. Binding arbitration in Cameroon if mediation fails

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our Platform. Your continued use of the Platform after such notification constitutes your acceptance of the modified Terms.

14. MISCELLANEOUS

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickGrab regarding your use of the Platform.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

14.4 Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights under these Terms without your consent to a related entity or in the event of a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
